Sustains the Mercantile Trust
In an opinion handed down yesterday, Judge Holt, in the United States Circuit Court, sustains the demurrer interposed by the defendant in the case of John W. Young against the Mercantile Trust Company, holding that the complaintant's remedy lies in an action at law, and not one in equality. The action was brought by John W. Young, one of the promoters of the Shipbuilding Trust, against the Mercantile Trust Company for an accounting of $60,000,000 of the securities of the Shipbuilding Company.
